Our Practice Areas

Intellectulaw takes a unique approach to the practice of Intellectual Property Law because we combine knowledge and experience gained from litigation to aid in strategic filings with and responses to actions by the USPTO, and vice-versa we use our knowledge dealing with entities like the USPTO and negotiating contracts to more effectively represent our clients in disputes.

Patents

Our attorneys are experienced in diverse backgrounds such as mechanical, electrical, chemical, bio-chemical, food, and technology areas. We represent our clients in various manufacturing and service areas in all aspects of patent application, prosecution, and post-patenting maintenance. As a result, our attorneys are capable of truly understanding your invention and can help you determine the best course of action to achieve your goals, protect your inventions, and implement of the law of patents in a manner that makes the most sense for you and your business.

Such strategy can include: advising on the patentability of an invention; conducting patent searches to determine in advance of application whether a product or process meets statutory requirements; preparing and filing domestic patent applications; and preparing and filing applications in foreign jurisdictions.

Copyrights

Our attorneys have extensive experience dealing with visual arts, literary works, musical works, and the entertainment fields. We assist clients in obtaining copyright protection for all textual, visual, or graphical works. Our attorneys are also versed in the software development field, giving unique perspectives on securing protection of programs, databases, and other technology applications.

Our initial consultations are an exploration of your goals, values, and objectives that we will use to structure a strategy so that you can achieve those goals through the proper management of your copyrights and the implementation of the law of copyrights in a manner that makes the most sense for you and your business. This includes: preparing and filing copyright applications with the United States Copyright Office; understanding your ability to enforce your copyright domestically and in foreign jurisdictions, and ensuring that you are receiving all possible royalties for your work.

Business & Commercial Litigation

Our attorneys' litigation experience encompasses the full range of legal representation necessary to resolve virtually any business dispute through court proceedings, administrative hearings, or alternative dispute resolution. We are conscious of the expensive of litigation and work hard to favorably resolve your problems without going to trial wherever possible. Our goal is to enable decision-makers to assess risk early on in potential conflicts and allocate resources strategically to maintain their reputation without disrupting their ability to do business.

Our attorneys are capable of representing you in contract disputes, employer-employee conflicts, landlord-tenant conflicts, franchisor-franchisee conflicts, derivative and shareholder disputes, misappropriation and trade secrets disputes, defamation and libel cases, and other matters that may result in financial liability or operational disruption.

License & Distribution Agreements

If you have secured protection of your intellectual property, one of your next steps may be to leverage it through various kinds of contracts. License agreements, distribution agreements, franchise agreements, mergers and acquisitions, and other intellectual property related contractual agreements are some of the most important aspects of protecting our client’s assets.

Our attorneys are skilled in representing our clients throughout the negotiation and drafting processes. We ensure that any agreement that our clients enter into effectively protects their past, present, and future rights in all matters of intellectual property.

Trademarks

Our attorneys have significant experience with the United States Patent and Trademark Office. Our initial consultations are an exploration of your goals, values, and objectives that we will use to structure a strategy so that you can achieve those goals through the proper management of your trademarks and the implementation of the law of trademarks in a manner that makes the most sense for you and your business.

Our services include: extensive in-house trademark searches; provision of letters of opinion; preparation and filing of domestic trademark applications; coordination and filing of foreign trademark applications; and consultation on new designs and trade dress.

Intellectual Property Litigation

Because of its complexity, an intellectual property lawsuit can be expensive. Our attorneys are conscious of this and work hard to favorably resolve your problems without going to trial. When the traditional approaches to infringement cases such as cease-and-desist letters, temporary restraining orders, or preliminary injunctions fail to produce the desired results, we have the experience to use the legal process to protect your useful or creative ideas, whether through litigation or through alternative dispute resolution. On the other hand, we understand that receiving a cease-and-desist or demand letter can be jarring. With that in mind, we provide defense techniques to best resolve the matter discreetly, with as little cost as possible, and without disrupting your ability to do business whenever possible.

Corporate Formation

Whether building a business from the ground up or transitioning from one corporate structure to another, it can be challenging to ensure you are making the right decisions without legal guidance. Our attorneys are experienced in drafting and filing corporate formation documents including Articles of Organization or Incorporation, By-Laws, and Operating Agreements. We are happy to work hand in hand with businesses and their accountants to establish their corporate structure and file documents with their Secretary of State.
Whether establishing a Limited Liability Company (LLC), C-Corporation, S-Corporation, B-Corporation, or Nonprofit Organization, our attorneys are experienced and willing to get your business going or transitioned to a new, more beneficial form.

General Businsess Contracts

Going into a contract negotiation alone can be harrowing for new business owners and cumbersome for experienced business owners. Our attorneys are skilled in representing our clients throughout the negotiation and drafting processes and their goal is to ensure that any agreement that our clients enter into effectively protects their past, present, and future rights in the relationship. The purpose of a contract is to create a legally binding document that clearly defines the rights, duties, and terms between two or more parties. Having capable representation can prevent future disagreements by putting all expectations in writing and structuring potential outcomes in such a way that allows our clients successfully to comply with the terms of the agreement, assess risks stemming therefrom, and maintain their reputation without disrupting their ability to do business.

What Makes Us Different

We partner with select clients to use intellectual property laws in a manner that most impacts both their personal and business goals, their values, and their intentions. We use our knowledge of our client's goals, our client's business, their position, and the legal issues impacting them to structure a strategy to best support and protect them.

We make our clients part of the process, keeping them in the loop, bringing them clarity on issues, and providing them with the knowledge that they need to make informed decisions along the way.  In our experience, the result is that our clients are more in control of the results they seek than with any other approach.   If you think this very different approach might be appropriate for your situation, contact us to arrange an exploratory meeting or conference.
